Regulations and terms of renting apartments in Memory Apartments facilities<\/h1>\n<\/div><\/div>\n\n
\n

GENERAL PROVISIONS<\/b><\/h2>\n

To avoid misunderstandings and ensure a pleasant stay, please read the following regulations, which are an integral part of the rental agreement, which is concluded by making a reservation and paying the full amount for the stay. By completing the above-mentioned activities, the Guest confirms that they have read and fully accept the terms of the regulations and undertakes to comply with them. Julita W\u00f3jtowicz-Sap Memory Apartments\u00a0 <\/b>with its registered office in Krak\u00f3w 31-035, ul. Rzeszowska 4 lok.7, NIP: 9441119798, REGON: 520784849 - which is entered into the register of the Central Registration and Information on Business, for which the Minister of Development and Technology is responsible.<\/p>\n

I. BOOKING, RENTAL AGREEMENT AND PAYMENT METHODS<\/b><\/h2>\n
    \n
  1. Reservations can be made free of charge via a web browser on the website: https:\/\/memoryapartments.pl\/<\/a> <\/span><\/span>via the booking form, by phone at (+48) 502 695 096 or by email\u00a0memoryaparts@gmail.com<\/a>\u00a0<\/a><\/span><\/span>, during the booking process, you must provide all required data such as: Personal data, address details, contact number and e-mail address.<\/li>\n
  2. After making a reservation using the selected method, detailed information about the reservation will be sent to the email address provided by the Guest<\/li>\n
  3. Making a reservation online and paying the full reservation fee constitutes the Customer's acceptance of these Terms and Conditions in their entirety. The Terms and Conditions are publicly available on the website:\u00a0 https:\/\/memoryapartments.pl\/kontakt\/regulamin-pobytu\/<\/span><\/a><\/span> <\/span><\/li>\n
  4. The reservation will be confirmed only after the payment specified in the reservation has been received, in accordance with the deadline specified after making the reservation and by e-mail to the address provided by the Guest in the reservation form.<\/li>\n
  5. Payments can be made online via the online payment service: Przelewy24 (the regulations of the imoje payment service provider can be found at: https:\/\/www.przelewy24.pl\/regulamin<\/span><\/a><\/span>) or by traditional bank transfer to the bank account indicated by Memory Apartments. Detailed payment information is sent to the Guest via email to the email address provided by the Guest in the reservation form.<\/li>\n
  6. Failure to pay by the deadline specified when making the reservation, while maintaining the free cancellation period, before the start of the stay constitutes the Guest's withdrawal from the apartment rental agreement and results in the immediate cancellation of the reservation. The Guest will be informed of this fact by email to the email address provided by the Guest in the reservation form. Persons under 18 years of age (hereinafter referred to as \"minors\") are not permitted to make a reservation or check in at the property on their own.<\/li>\n
  7. The facility issues invoices excluding value added tax (VAT-exempt invoices)<\/li>\n
  8. \u00a0If you would like to receive an invoice, please notify the landlord no later than the day of check-in. In accordance with tax law, a request for an invoice must be submitted within three months of the end of the month in which your stay ended.<\/li>\n<\/ol>\n

    II. CHECK-IN, STAY AND CHECK-OUT<\/b><\/h2>\n
      \n
    1. The apartment is rented solely for\u00a0stay and recreation purposes.\u00a0<\/b>and is intended solely for the use of registered residents. Sharing the rented apartment with third parties without prior approval from Memory Apartments is strictly prohibited. We reserve the right to immediately terminate the agreement in the event of a breach of this provision.<\/li>\n
    2. There is an absolute\u00a0ban on conducting any business activity in the premises.<\/b> i.e. commercial activities and the provision of services, as well as illegal activities, in particular those related to prostitution, pimping, and the provision of erotic services. In the event of a violation of the above prohibitions, the lease agreement will be terminated with\u00a0with immediate effect<\/b>, and guests are obliged to leave the apartment immediately\u00a0without the right to a refund<\/b> for the unused period of stay and other ordered services. The appropriate law enforcement authorities will be notified of the matter.<\/span><\/li>\n
    3. Check-in and access to the apartment is hands-free using a unique lock code or the safe's access code. For safes, check-in is accomplished using the access card inside. Access codes are emailed to guests prior to their stay. Access codes can also be sent via text message upon prior arrangement. Access codes will be sent after booking confirmation and payment has been made to the email address or contact number provided by the guest on the booking form.<\/li>\n
    4. The property reserves the right to refuse check-in if a minor arrives at the property unaccompanied by a parent or legal guardian. In such a situation, the property is not obligated to refund any prepayments. Upon check-in, a Memory Apartments employee has the right to verify the identity and age of all guests, including the minor.<\/li>\n
    5. The apartment is rented on a short-term basis. Check-in begins at 2:00 PM and ends at 10:00 AM on the day of check-out. Guests are not permitted to transfer or share the apartment with other guests during the rental period.<\/li>\n
    6. On the day of check-out, guests must vacate the apartment according to the scheduled time of stay and lock the apartment's entrance door upon leaving. The access card must be left at the initial pickup location.<\/li>\n
    7. Memory Apartments offers paid late check-out and extended stay options, subject to availability. These services require prior approval from the property. Payment for any additional amenities must be made by the due date. We reserve the right to cancel any service if it is not confirmed or paid for.<\/li>\n
    8. Requests to extend your stay beyond the period of your reservation or during your stay should be submitted to the staff at least one day before your stay ends. Staff will consider any requests to extend your stay based on availability and availability.<\/li>\n
    9. In the event of departure before the planned end date of the stay, there is no refund for unused but paid days.<\/li>\n
    10. Personal items left in the apartment by the Guest after check-out will be kept for a period of\u00a07 days<\/b>The property is not responsible for items left after 7 days of check-out. Staff will attempt to contact the guest (by phone or email) to arrange for their collection. The cost and organization of return shipping are the sole responsibility of the guest.<\/li>\n
    11. Guests are required to inform the property staff of their preferred bed configuration no later than the day before their planned arrival. If no such notification is provided, the staff will arrange the beds according to their discretion and the property's current logistical capabilities. Any changes to the bed configuration made at the guest's request after their arrival (on the day of arrival) are subject to a one-time additional fee of PLN 100.<\/li>\n

      III. LIABILITY AND FACILITIES<\/span><\/b><\/h2>\n
        \n
      1. The guest is obliged to observe quiet hours from 10 p.m. to 6 a.m.<\/li>\n
      2. Memory Apartments are not liable for the loss or damage of material items brought into the apartment by the Guest, for stored money, securities and valuable items owned by Guests, including valuables and items of scientific or artistic value, if the damage resulted from the nature of the item brought in or as a result of force majeure or was caused solely by the fault of the injured party or the person accompanying him.<\/li>\n
      3. Memory Apartments properties are not responsible for any interruptions in electricity, water, or heating supply resulting from network failures, force majeure, or other factors beyond the property's control. Should such a situation occur, the staff will make every effort to minimize its effects.<\/li>\n
      4. The Guest should immediately inform the Memory Apartments staff about any faults occurring in the apartment during their stay by calling the following number: +48 502 695 096.<\/li>\n
      5. In the rented apartment and building, i.e. kitchen, bathroom, hall, living room, bedroom, balcony, staircase\u00a0smoking is strictly prohibited<\/u><\/b> smoking tobacco, e-cigarettes, tobacco heaters, vaporizers and using any devices that emit smoke, steam or fire, with the exception of kitchen equipment<\/b>.<\/u> Violation of the smoking ban in places covered by it will result in a financial penalty of PLN 1,000 (covering the costs of ozonation and closing the apartment for the time of cleaning) and immediate termination of the rental agreement without refund.<\/li>\n
      6. The Guest agrees not to exceed the number of people staying or staying overnight in the apartment specified in the booking form. Otherwise, the Guest will be required to pay an additional fee for the number of people staying with them.<\/li>\n
      7. The guest of the apartment bears full financial responsibility for any damage or destruction caused to any equipment and objects located in the apartment.<\/li>\n
      8. The guest is obliged to immediately report any damage caused by him during his stay and is fully financially responsible for any damage caused to the apartment and the building in which the premises are located.<\/li>\n
      9. All faults reported later than the first day of stay will be charged to guests currently staying.<\/li>\n
      10. It is strictly forbidden to remove any of the apartment's furnishings, which are the property of Memory Apartments. Theft will be reported to the appropriate authorities and subject to financial penalties.<\/li>\n
      11. In the event of unforeseeable circumstances, the effects of which cannot be immediately eliminated, Memory Apartments undertakes to provide a replacement apartment, similar to the one originally booked, if it has one available.<\/li>\n
      12. Parents or guardians are responsible for children staying on the premises. The facility does not have safety measures to protect small children.<\/span><\/li>\n
      13. Memory Apartments is responsible for any inconvenience caused during your stay related to: construction or finishing works that may be carried out on the premises and in the vicinity of the facility where the apartment is located, as well as interruptions in the supply of utilities.<\/li>\n
      14. Each time the Guest leaves the apartment during their stay, they are obliged to secure it by closing the entrance door and windows, turning off the air conditioning and turning off the heating plate and other working electrical devices.<\/li>\n
      15. The apartment rental price includes cleaning after the reservation period and is included in the rental price. Additional cleaning services during the stay, including linen and towel changes, are available upon request for an additional fee.<\/li>\n
      16. For the sake of safety, hygiene and security of the apartment's property\u00a0It is strictly forbidden to bring and store bicycles inside the apartment<\/u>Guests can rent a private bicycle storage unit for an additional fee. Failure to comply with the ban on storing bicycles in the apartment will result in a PLN 500 fine and immediate termination of the rental agreement without refund.<\/li>\n
      17. For the comfort and safety of all guests, as well as to prevent potential allergies, property damage and other inconveniences\u00a0Pets are not allowed in Memory Apartments.<\/u><\/li>\n
      18. The Guest undertakes not to transmit, publish or make available any content that is or may be considered illegal, infringes the rights of third parties, including copyrights, personal rights, personal rights or other rights protected by law, as well as content that is offensive, vulgar, threatening, discriminatory, promotes violence, hatred or any other activities contrary to the law or good manners.<\/li>\n
      19. The parent or legal guardian is obliged to stay in the facility throughout the entire stay of the minor and bears full civil and legal responsibility for him\/her.<\/li>\n
      20. Failure to comply with the above-mentioned rules may result in immediate termination of the rental service without the right to a refund for the stay.<\/li>\n<\/ol>\n

        \u00a0IV. CANCELLATION AND COMPLAINTS<\/b><\/h2>\n
          \n
        1. Full payment is required 7 days before the planned stay, or on the day of the last-minute booking. Failure to pay by the deadline will result in automatic cancellation of the reservation.<\/li>\n
        2. Cancellation of reservation (if the reservation is paid):<\/li>\n<\/ol>\n

          Free of charge up to 7 days before arrival<\/b><\/p>\n

            \n
          1. Cancellations outside the free cancellation period, after payment of a deposit, and before the start of the stay will incur a 40% cancellation fee. However, if the reservation is canceled on the day before or on the day of arrival, or in the event of a no-show, the guest will be charged 100% of the total reservation value. This amount compensates the property for lost benefits and costs incurred in preparing the apartment for the guest's stay.<\/li>\n
          2. To cancel a reservation, the Guest is obliged to contact the staff by e-mail at the following address: memoryaparts@gmail.com<\/a>Refunds of any deposits made towards your reservation will be made within 7 calendar days, in accordance with the cancellation policy set out in the terms and conditions.<\/li>\n
          3. The Lessor reserves the right to refuse to accept a Guest and cancel the reservation without the right to a refund if, during the previous stay, he or she grossly violated the facility's regulations or caused damage to the property of the facility or other Guests, or caused physical harm to persons staying on the premises of the facility or otherwise disturbed the peaceful stay of other Guests.<\/li>\n
          4. Complaints regarding the performance of the short-term rental agreement may be submitted by the Guest in writing, providing a description of the problem. The complaint may be sent electronically to the following email address: memoryaparts@gmail.com<\/span><\/a><\/span> <\/span>or in writing to the registered office of Memory Apartments, Julita W\u00f3jtowicz-Sap, ul. Rzeszowska 4\/7, 31-035 Krak\u00f3w. The Service Provider will respond to the complaint within 14 days of receiving the letter, replying to the address provided by the Guest.<\/li>\n
          5. Pursuant to Article 38, Section 12 of the Consumer Rights Act, the right to withdraw from a distance contract within 14 days does not apply to accommodation services with a specified performance date. This applies to individuals and business owners, provided that the purchase is directly related to their business activity but is not of a professional nature for them.<\/li>\n<\/ol>\n
